Terms of Use

These Terms of Use ("Terms") govern your access to and use of the landing page and subscription service (the "Landing Page"), operated by:

4GOO Holding GmbH Landauer Str. 56, 67346 Speyer, Germany ("Company", "we", "us", or "our")

By accessing this Landing Page or submitting your details through the subscription form, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, please do not use this Landing Page.

These Terms apply solely to this Landing Page and the beta subscription service. They do not govern the use of the 4GOO social network application, which will be subject to a separate set of Terms at the time of its public launch.

The Landing Page provides a pre-launch subscription service ("Service") that allows interested users to:

• Register their interest in receiving early or beta access to the 4GOO application;
• Receive informational and marketing communications about the development, features, and launch timeline of the 4GOO platform;
• Optionally receive a beta invitation when limited early access becomes available.

No account is created by submitting the subscription form. Submission does not constitute a contract for the provision of the 4GOO application, nor does it guarantee access to the beta programme or the final product.

To use the Landing Page and submit the subscription form, you must:

1. Be at least 16 years of age. If you are between 13 and 16, you may only subscribe with verifiable parental consent. The Landing Page is not directed to children under 13.

2. Have the legal capacity to enter into binding agreements in your jurisdiction.

3. Not be subject to any legal prohibition on receiving communications from entities established in the European Union.

By submitting the form, you represent and warrant that you meet the eligibility requirements above.

4.1 Subscription. By entering your email address and submitting the form, and confirming via the verification email sent to you, you consent to receiving email communications from us relating to the 4GOO beta programme and product launch, as further described in our Privacy Policy.

4.2 Double Opt-In. Upon submitting the form, you will receive a confirmation email. Your subscription is only activated upon clicking the confirmation link in that email. This ensures your consent is verified and protects you against unauthorised subscriptions.

4.3 No Guarantee of Access. Subscribing does not guarantee beta access or that any version of the 4GOO application will be made available to you. Beta access is extended at our sole discretion on a limited basis.

4.4 Unsubscribing. You may withdraw your consent at any time by:

• Clicking the "Unsubscribe" link in any email we send you (effective immediately); or
• Emailing [email protected] with the subject line "Unsubscribe."

4.5 Accuracy of Information. You agree to provide accurate, current, and complete information when submitting the subscription form.

You agree to use the Landing Page only for lawful purposes and in accordance with these Terms. You must not:

• Submit false, misleading, or fraudulent information in the subscription form;
• Use automated tools, bots, or scripts to interact with or submit the form;
• Attempt to gain unauthorised access to any systems or infrastructure supporting the Landing Page;
• Upload or transmit any malware, viruses, or other malicious code;
• Interfere with or disrupt the integrity or performance of the Landing Page;
• Use the Landing Page in a manner that could damage our reputation or that of any third party;
• Violate any applicable law, including anti-spam legislation (EU ePrivacy Directive, CAN-SPAM, CASL).

6.1 Our Rights. All content on the Landing Page — including text, graphics, logos, the 4GOO name and brand, and underlying software — is the exclusive intellectual property of 4GOO Holding GmbH or its licensors, protected by applicable copyright, trademark, and intellectual property laws.

6.2 Restrictions. You may not reproduce, distribute, modify, or otherwise exploit any content on the Landing Page without our prior written consent.

6.3 Feedback. If you provide suggestions or feedback about the 4GOO product, you grant us a non-exclusive, royalty-free, perpetual, worldwide licence to use such feedback for any purpose without compensation.

The Landing Page and subscription service are provided "as is" and "as available", without warranties of any kind, either express or implied, including warranties of merchantability, fitness for a particular purpose, or uninterrupted and error-free operation. We reserve the right to modify, suspend, or discontinue the Landing Page or the 4GOO product at any time without prior notice.

8.1 To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages arising out of your use of the Landing Page.

8.2 Our aggregate liability for direct damages shall not exceed EUR 100.

8.3 Nothing in these Terms excludes liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any liability which cannot be excluded under applicable law (including mandatory consumer rights in your jurisdiction).

Your use of the Landing Page is governed by our Privacy Policy (above), which is incorporated into these Terms by reference.

As of the current version of the Landing Page, we do not use cookies, analytics, or tracking technologies beyond what is strictly necessary to serve and secure the page. If we introduce such technologies in the future, we will update our Privacy Policy, publish a Cookie Policy, and — where required — implement a consent mechanism before any such technologies are activated.

The Landing Page may contain links to third-party websites and services. These links are provided for convenience only. We have no control over those sites and accept no responsibility for them or for any loss arising from your use of them.

We reserve the right to update these Terms at any time. Material changes will be communicated by updating the "Last Updated" date and, where appropriate, by notice on the Landing Page or via email. Continued use of the Landing Page after changes constitutes acceptance of the updated Terms.

13.1 These Terms are governed by the laws of Germany and the European Union, without regard to conflict-of-laws rules.

13.2 Consumer Disputes. EU consumers may bring proceedings in the courts of their country of habitual residence, with the benefit of mandatory local consumer protection laws. The EU ODR Platform is available at https://ec.europa.eu/odr .

13.3 Business / Commercial Disputes. Non-consumer disputes are subject to the exclusive jurisdiction of the competent courts of Speyer, Germany.

13.4 UK Residents. UK mandatory consumer protection law applies. Proceedings may be brought before UK courts as appropriate.

13.5 Pre-Litigation Resolution. Both parties agree to attempt in good faith to resolve any dispute through direct negotiation for at least 30 days before initiating legal proceedings.

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and 4GOO Holding GmbH with respect to the Landing Page.
